General

1. The Here’s The Beef Burger Bash (the “Contest”) will begin on June 15, 2009 at 12:01 am ET and will end on July 31, 2009, at 11:59 pm ET (the “Contest Period”). This contest is being conducted by Hero Certified Burgers (the “Contest Sponsor”).
2. Before entering the Contest, each entrant must review and agree to be bound by the Contest Rules and Regulations as set out below. By entering the Contest, entrants accept and agree to be bound by the Contest Rules and Regulations, and accept the decisions of the independent contest judging organization and Contest Sponsor as final and binding in all respects.

Eligibility

3. The contest is open to all legal residents of Ontario's who live within 25km of any Hero Burger location (The following are Hero Burger locations: 120 Adelaide Street West Toronto, 15340 Bayview Avenue Aurora, 230 Commerce Valley Dr East Markham, 6045 Creditview Road Mississauga, 10755 Leslie Street, Unit 201 Richmond Hill, 55 Avenue Road Toronto, 850 Main Street E, Unit #1 Milton, 650 1/2 Queen Street W Toronto, 1480 Major Mackenzie Drive Richmond Hill, 25 The West Mall Etobicoke, 21 St. Clair West Toronto, 3300 Bloor Street West Etobicoke, 200 Elizabeth Street Toronto, 100 Wellington Street Toronto, 21 Famous Avenue Woodbridge, 79A Yonge Street Toronto, 9625 Yonge Street, Unit 7 Richmond Hill) and who have reached the age of majority. Employees, representatives, agents, shareholders, officers and directors of the Contest Sponsor, its advertising and promotional agencies, and any independent contest judging organizations, and those with whom the above are domiciled, are not eligible to enter. This Contest is void outside the jurisdictions listed above and where prohibited by law.
4. By entering the Contest, the winner consents, to the extent permitted by law, to the use of his or her name, image, voice, likeness, city of residence and/or photographs without compensation in any publicity or advertising carried out in any medium worldwide by the Contest Sponsor and/or its advertising or promotional agencies without limitation or further notification.

How to Enter

5. The contest can be entered by the following method:

   (a) enter online by going to www.heroburgerbash.com, completing the official entry form and submitting your entry as instructed.;

   Limit one entry per person/e-mail address/household during the entire contest period.

6. All entries must be received within the contest period.
7. Entries that are incomplete, damaged, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of these contest rules shall be disqualified. if it is discovered that an entrant has attempted to enter more than one entry, he/she may be disqualified.
8. The contest sponsor is not responsible for any lost, late, delayed, inaudible, incomplete, stolen, misdirected, damaged, altered, or destroyed entries.
9. All entries become the sole property of the contest sponsor and will not be returned

Prize

10. There is one (1) Grand Prize available to be won (the “Grand Prize”). The Grand Prize consists of The Ultimate Burger Bash. This prize package consists of: 1 Napoleon Grill Ultra Chef UP405RB 59,000 BTU stainless barbecue. (Total approximate retail value = $639) plus a cash prize of $500.00 CAD payable by cheque, burgers and toppings barbecued at your home by Hero Burger team member for up to 20 friends, and a visit to the party from the Hero Steer (a larger than life size Hero Burgers corporate steer float), subject to availability (steer float is a not a ride). Total prize package approximate retail value = $1500. No prize substitutions can be made by winner. The Grand Prize winner must hold their “Burger Bash” barbecue event at their home or a location mutually agreed to by the owner and Hero Burgers, on a mutually agreeable date before August 31, 2009.
11. All taxes, gratuities, and any other expenses connected with the Prize which are not specifically mentioned above are the winner’s sole responsibility.
12. The Contest Sponsor, in its sole discretion and subject to applicable law, reserves the right to substitute any portion of the Prize with something of equal or greater value if an advertised Prize or portion thereof becomes unavailable. The Contest Sponsor reserves the right, in its sole discretion to terminate or suspend the Contest, or modify the Contest Rules and Regulations at any time for any reason whatsoever if fraud or other reasons beyond the control of Contest Sponsor corrupt the security or administration of the Contest.

Draw

13. All eligible entries will be entered in a random draw conducted by PGeMarketing Services, the Independent Judging Organization. There will be one draw for the Grand Prize detailed above. On or about 2:00 pm ET, in Markham, Ontario, August 5, 2009, a random draw will be conducted from all eligible entries received for the Grand Prize.
14. The selected entrant will be notified by telephone and/or email within approximately two (2) days of the Draw (“Notification”). The Contest Sponsor assumes no responsibility for any inaccurate or incorrect information provided to them, or that results in any way from the transmission, receipt or processing of entries. If the first selected entrant for any Prize does not respond to the Contest Sponsor within five (5) days of the first contact, the Contest Sponsor shall have the right to disqualify that entrant and to randomly draw another eligible entry. By entering, you agree that if you are a selected entrant that is disqualified and a prize is forfeited for any reason, the Contest Sponsor shall be fully and completely released and discharged from any liability or responsibility in this regard. The Contest Sponsor is not responsible for the failure for any reason whatsoever of a selected entrant to receive Notification.
15. Upon Notification, the selected entrant must, unaided, correctly answer a time-limited mathematical skill-testing question. In the event that the selected entrant is unable to answer the skill-testing question correctly, the Contest Sponsor shall have the right to disqualify said entrant and to randomly draw another eligible entry, and the Contest Sponsor shall be fully and completely released and discharged from any liability or responsibility in this regard.
16. If the selected entrant is not eligible or does not otherwise meet the requirements as set out in the Contest Rules, the Contest Sponsor shall have the right to disqualify said entrant and randomly draw another eligible entry for purposes of awarding the prize, and the Contest Sponsor shall be fully and completely released and discharge from any liability or responsibility in this regard.

General Conditions

17. By entering the Contest and accepting a prize, the selected entrant and his or her guests (or their parent/legal guardian if minors) agree to release and hold harmless the Contest Sponsor, its directors, employees, officers and agents, including, without limitation, its advertising and promotion agencies, the prize suppliers, the independent contest judging organization (all collectively called the “Promotional Parties”) from any injury, loss or damage of any kind to persons or property, including but not limited to death, resulting in whole or part directly or indirectly from the acceptance, receipt, possession, use or misuse of the awarded Prize, participation in any Contest-related activity, including any travel related thereto, or participation in the Contest.
18. By entering the Contest, the selected entrant agrees to sign and return the following to the independent contest judging organization within fourteen (14) days of Notification:

    (a) A form affirming eligibility and compliance with all Contest Rules ;

    (b) A liability release form releasing the Promotional Parties from all liability arising from or relating to the acceptance, receipt, possession, use or misuse of the awarded Prize, participation in any Contest-related activity including any travel related thereto, or participation in this contest.

    (c) A publicity release form permitting the Contest Sponsor or its agents to use his or her name, image, voice, likeness, city of residence and/or photographs without compensation in any publicity or advertising carried out in any medium worldwide by the Contest Sponsor and/or its advertising or promotional agencies without limitation or further compensation or notification, unless prohibited by law. Note that a photographer may attend all or part of any of the winning prize package to photograph winning participant and his/her guests. In addition, each guest attending the Grand Prize party must sign and return a liability and publicity release form before attending the Grand Prize party. In the event that any guest is a minor in his/her province, or territory of residence, his/her parent or legal guardian must sign the documents on his/her behalf. If the selected entrant fails to submit the above within the given time period, the Contest Sponsor reserves the right to disqualify said entrant and randomly draw another eligible entry for the purpose of awarding the prize (time permitting), and the Contest Sponsor shall be fully and completely released and discharged from any liability or responsibility in this regard. The Contest Sponsor reserves the right, in its sole discretion to terminate or suspend the Contest, or modify the Contest Rules and Regulations at any time for any reason or should fraud, virus, bugs or other causes beyond the control of the Contest Sponsor corrupt the administration, security or proper play of the game.

19. The Contest Sponsor shall not be liable for any human or technical errors that may arise or occur in connection with the Contest. The Contest Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of the entries.
20. The Contest Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any e-mail or entry to be received by the Contest Sponsor as a result of technical problems, human error or traffic congestion on the Internet or at any website, or any combination thereof, any injury or damage to the entrant’s or any other person’s computer related to or resulting from participation or downloading or accessing any materials in this contest.
21. The Contest Sponsor reserves the right at its sole discretion to disqualify any individual who tampers with or attempts to tamper with the entry process. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE CONTEST SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW INCLUDING CRIMINAL PROSECUTION.
22. In the event of a dispute, entries made by Internet will be declared to have been made by the Authorized Account Holder of the e-mail address submitted at the time of entry. “Authorized Account Holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
23. This Contest is governed by the laws of Ontario and the laws of Canada applicable therein, and is subject to all applicable federal, provincial and municipal laws and regulations.
24. By entering this Contest, each entrant agrees that the courts of the Province of Ontario, Canada shall have jurisdiction to entertain any action or other legal proceedings based on any provision of these Contest Rules and Regulations or the running of this Contest. Each entrant hereby irrevocably attorns to the exclusive jurisdiction of the courts of the Province of Ontario.
25. For the name of the winner send a self addressed postage stamped envelope to: “Here’s The Beef Burger Bash Contest” Win List, c/o PGeSignature at 89 Bloor Street West, Suite 202, Toronto, Ontario, M5S1M1 by August 31, 2009.
26. THE CONTEST SPONSOR IS COLLECTING, HOLDING AND USING PERSONAL INFORMATION ABOUT ENTRANTS (AND DISCLOSING IT TO THIRD PARTIES IF NECESSARY) FOR THE PURPOSES OF ADMINISTERING THIS CONTEST; AWARDING AND DELIVERING PRIZES AND ANNOUNCING THE WINNER AS SET OUT ABOVE NO FURTHER MARKETING COMMUNICATIONS WILL BE RECEIVED BY ENTRANTS UNLESS ENTRANTS PROVIDE EXPLICIT PERMISSION TO DO SO.
